ARTICLE 1: ORGANIZING COMPANY

Company Le PAL SAS, having its registered office at Le PAL 03290 Dompierre-sur-Besbre, registered in the Cusset Trade and Companies Register under number 788 139 632 00012, is organizing from April 8 to September 30, 2023 a competition entitled " Your best PAL photo ”.
The Apple company is not involved in this competition in any way.

ARTICLE 2: THE PARTICIPANTS

The Game is open to any adult residing in Metropolitan France (Corsica included), excluding the staff of the Organizing Company and its service providers, as well as those of the Professional Civil Society RAY-LANGEVIN, Bailiffs in DOMPIERRE-SUR-BESBRE (Allier), 251, Rue de La Fontaine, as well as any person having family ties with said staff.

ARTICLE 3: TERMS OF PARTICIPATION

3.1 Participation

Participants must go to the PAL smartphone application.
Participants must complete all fields of the participation form and attach a photo, which they will have previously made sure to benefit from the rights, for their registration to be validated and to accept the conditions of the competition.
The participations for each month are defined as follows:

  • For April, entries sent from April 8, 2023 12:00 a.m. to April 30, 2023 11:59 p.m.
  • For May, entries sent from May 1, 2023 12:00 a.m. to May 31, 2023 11:59 p.m.
  • For June, entries sent from June 1, 2023 12:00 a.m. to June 30, 2023 11:59 p.m.
  • For July, entries sent from July 1, 2023 midnight to July 31, 2023 11:59 p.m.
  • For August, entries sent from August 1, 2023 12:00 a.m. to August 31, 2023 11:59 p.m.
  • For September, entries sent from September 1, 2023 12:00 a.m. to September 30, 2023 11:59 p.m.
3.2 Course of the Game

Once the steps described in point 3.1 have been completed, participants are eligible to win one of the prizes involved.

  • In April, May and June 2023, a photo will be chosen by PAL's digital communication department.

The author of the selected photo will be the winner and will be notified by email of their winning.

  • In July, August and September 2023, seven (7) photos will be chosen by PAL's digital communication department.

The authors of the selected photos will be the winners and will be informed by email of their prize.

The number of winners as well as the prizes that will be offered are detailed in Articles 4 and 5 below.

3.3 Number of participation per person

Only one entry per person is allowed.

3.4 Participations not taken into account

The following participations will not be taken into account:

  • For April, entries sent before April 8, 2023 and after April 30, 2023 11:59 p.m.
  • For May, entries sent before May 1, 2023 and after May 31, 2023 11:59 p.m.
  • For June, entries sent before June 1, 2023 and after June 30, 2023 11:59 p.m.
  • For July, entries sent before July 1, 2023 after July 31, 2023 11:59 p.m.
  • For August, entries sent before August 1, 2023 and after August 31, 2023 11:59 p.m.
  • For September, entries sent before September 1, 2023 and after September 30, 2023 11:59 p.m.

Any participation made contrary to the provisions of these rules will render the participation invalid.

Any participant suspected of fraud may be excluded from the competition by the “organizer” without the latter having to justify it.

Any incomplete, erroneous or illegible identification or entry, whether intentionally or not, or carried out in a form other than that provided for in these rules will be considered void.

3.5 Free game with no purchase obligation

The rules of the game will be sent free of charge to anyone who requests them from Le PAL 03290 Dompierre-sur-Besbre. Postal charges will be reimbursed at the rate in force on simple concomitant request.

No registration fee will be charged. In order to ensure total free access, any participant in the competition can obtain on request the reimbursement of the costs incurred for participation in the competition, on the basis of a reimbursement of the cost of the internet connection at the rate of 3 (three) minutes, time means necessary to participate in the Game.

The reimbursement request must be sent by post to Le PAL 03290 Dompierre-sur-Besbre, at the latest (8) eight days after the closing date of the game, the postmark being taken as proof. The costs incurred by the participant for this request will be reimbursed on request on the basis of the "letter" rate for Europe in force.

Only one request for reimbursement of participation per participant will be taken into account.
The participant must accompany his request with the following documents (in his name or in the name of his parent / legal representative, if applicable):

  • The indication, on plain paper, of his names, first names, postal address, the date of his registration in the game;
  • A bank identity statement (RIB);
  • A photocopy of their subscription to their Internet service provider.

These parts will be destroyed after sending the refund.

Moreover, any reimbursement can, by definition, only be made if there has been an actual disbursement by the participant. Under these conditions, packages allowing an unlimited connection to the Internet or connections made as part of an hourly package subscribed each month by Internet users are excluded. The organizing company reserves the right to carry out any verification it deems useful, to request any supporting documents and, if necessary, to initiate any legal proceedings.

ARTICLE 4: DESIGNATION OF EARNINGS

One (1) Le PAL Season Pass will be awarded in April, May and June 2023 for a total value of €246 including tax corresponding to 3 (three) Le PAL Season Pass.

Each winner will be awarded a Season Pass. The unit value of a Season Pass is €82 including tax.

These Season Pass will be valid during the 2023 season. They are personal and give unlimited access to the PAL on the days and opening hours of the park.

Fourteen (14) free PAL entries will be awarded in July, August and September 2023 for a total value of €1,428 including tax (one thousand three hundred and forty-four euros) corresponding to 42 (forty-two) PAL entries.

Each winner will be awarded two (2) free entries. The unit value of an entry is € 34 including tax, or a total value of € 68 including tax for a prize.
The free PAL entries for the month of July and August 2023 will be valid during the 2023 season. The free PAL entries for the month of September 2023 will be valid during the 2024 season. The free entries give access to the PAL one day per day and opening hours of the park.

The value of the prizes is determined at the time of writing of these rules and cannot be the subject of a dispute as to their evaluation.

ARTICLE 5: DESIGNATION OF WINNERS

One photo per month will be chosen for the months of April, May and June 2023. Seven (7) photos per month will be chosen for the months of July, August and September 2023, to determine the winners on the following dates:

  • For April during week 18.
  • For May during week 23.
  • For June during week 27.
  • For July during week 32.
  • For August during week 36.
  • For September during week 40.

ARTICLE 6: PRIZE DELIVERY

The winners will be informed by email at the latest 15 days after the designation of the photo of the month.

The winners for the month of April, May and June 2023 will contact the PAL secretariat service by email and must send the photo and the name, first name and postal address of the person who will benefit from the Season Pass no later than 15 days after the date of sending the email informing them of their winning.

The prize will be sent to the postal address provided by the winner no later than 15 days after receipt of the email containing the requested information.

The winners for the month of July, August and September 2023 will be directly contacted by an email containing their prize.

The winners undertake to accept the prizes as proposed without the possibility of exchange, in particular for cash, other goods or services of any kind, or transfer of the profit to a third person. Likewise, these prizes may not be the subject of compensation claims.

"The organizer" reserves the right, in the event of the occurrence of an event beyond its control, in particular related to its suppliers or to unforeseeable circumstances, to replace the announced prizes with prizes of equivalent value. The winners will be kept informed of any changes.

ARTICLE 7: USE OF PERSONAL DATA OF PARTICIPANTS

The information of the participants is recorded and used by "The organizer" to memorize their participation in the competition and allow the allocation of prizes.

Participants may, for legitimate reasons, object to their personal data communicated in the context of this game being processed. They also have a right of opposition to their being used for commercial prospecting purposes, other than participation in this competition, which they can assert upon registration of their participation in s '' sending a letter to "The organizer" whose address is mentioned in article 1.

The participants authorize “The organizer” to use the photos sent by the participants on the lepalofficiel Instagram account or on the lepalofficel Facebook page, without this conferring on them any remuneration, right or advantage, other than the attribution of their lot.

In accordance with the Data Protection Act of January 6, 1978, any participant has the right to demand that any information concerning him which is inaccurate, incomplete, equivocal or out of date be rectified, completed, clarified, updated or deleted. sending by mail to "The organizer" whose address is mentioned in article 1.

ARTICLE 8: LIMITATION OF LIABILITY

7.1 Force Majeure.

The responsibility of the Organizing Company can not be incurred if, for a case of Force Majeure, this Game should be modified, postponed, extended, shortened or canceled.

7.2 Postponement of the Game.

The Organizing Company reserves the right in all cases to extend the Duration of the Game and to postpone any date announced.

7.3 Limitation on Internet Functionality.

The Organizing Company and / or its eventual service provider undertakes to maintain its site in normal working order, 24 hours a day.

However, participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, risks of interruption, and more generally, the risks inherent in any connection and transmission over the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the network.

Consequently, the Organizing Company cannot under any circumstances be held responsible, without this list being exhaustive:

  • the transmission and / or reception of any data and / or information on the Internet,
  • any malfunction of the Internet network preventing the smooth running / functioning of the Game,
  • failure of any reception equipment or communication lines,
  •  the operation of any software,
  • the consequences of any virus, computer bug, anomaly, technical failure,
  • any damage caused to a participant's computer,
  • any technical, hardware and software failure of any kind which has prevented or limited the possibility of participating in the Game or having damaged a participant's system.

It is up to all participants to take all appropriate measures to protect their own data and / or software stored on their computer equipment against all expectations. The participation of participants in the Game is entirely their responsibility.

ARTICLE 9: ACCEPTANCE AND DEPOSIT OF THE GAME RULES

The simple fact of participating entails the full acceptance of these regulations filed with SCP RAY-LANGEVIN, bailiffs, 251, Rue de la Fontaine in DOMPIERRE-SUR-BESBRE (Allier).

The Organizing Company reserves the right to take legal action against anyone who has defrauded this Game or attempted to do so. It can not incur any liability of any kind vis-à-vis participants due to any fraud committed.

In the event of failure by a participant, the Organizing Company reserves the right to automatically exclude any participation from the latter, without the latter being able to claim any compensation.

"The organizer" reserves the right to extend, shorten, modify or cancel the game at any time, particularly in the event of force majeure, without any compensation being claimed by the participants. The regulations amended by amendment (s), will be filed, if necessary with the SCP RAY-LANGEVIN, bailiffs, 251, Rue de la Fontaine in DOMPIERRE-SUR-BESBRE (Allier).

ARTICLE 10: INDUSTRIAL AND INTELLECTUAL PROPERTY

The reproduction, representation or use of all or part of the elements making up the game, these regulations included are strictly prohibited.

All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the site as well as on the sites to which it allows access through hypertext links, are the exclusive property of their owners and are protected. as such by the provisions of the Intellectual Property Code for the whole world. Their unauthorized reproduction constitutes an infringement punishable by criminal penalties.

Any unauthorized reproduction, total or partial, of these brands, logos and signs constitutes an infringement liable to criminal penalties.

Participation in this game implies full acceptance of these rules by the participants.

ARTICLE 11: DISPUTES AND COMPLAINTS

These regulations are governed by French law.

"The organizer" reserves the right to settle without appeal any difficulty that may arise as to the interpretation or application of these regulations, it being understood that no dispute will be allowed in particular on the terms of the game, on the results. , on the winnings or their receipt, one month after the end of the game. Except in the case of obvious errors, it is agreed that the information resulting from the game systems of "The organizer" have probative force in any dispute as to the elements connection and computer processing of said information relating to the game.

Any complaint must be addressed within one month of the end of the game to "The organizer". After this date, no complaint will be accepted.

ARTICLE 12: AGREEMENT ON PROOF

By express agreement between the participant and "The organizer", the computer systems and files of "The organizer" will be the only authentic.

The computerized registers, kept in the computer systems of “The organizer”, under reasonable conditions of security and reliability, are considered as proof of the relations and communications between “The organizer” and the participant.

It is therefore agreed that, unless there is a manifest error, "The organizer" may rely, in particular for the purposes of proof of any act, fact or omission, of programs, data, files, recordings, operations and other elements (such as monitoring reports or other reports) of a nature or in computer or electronic format or medium, drawn up, received or stored directly or indirectly by "The organizer", in particular in its computer systems.

The elements considered thus constitute proof and if they are produced as means of proof by "the organizer" in any contentious or other procedure, they will be admissible, valid and opposable between the parties in the same way, under the same conditions and with the same probative force as any document drawn up, received or kept in writing.

Transactions of any kind, carried out using the identifier and code assigned to a participant, following registration, are irrefutably presumed to have been carried out under the responsibility of the participant.
